PROTECTIONS GAINED FROM A NEW HAMPSHIRE CIVIL UNION

A New Hampshire Civil Union gives partners automatic inclusion under the hundreds of New Hampshire laws that apply to married couples.  While the Civil Union Law does not spell out any specific benefits and responsibilities under those laws that will apply for civil union couples, categories of state laws that will include civil union couples are:

  • FAMILY LAW

  • TITLE, DESCENT, DESTIRUBTION AND INTESTATE SUCCESSION

  • WILLS, SURVIVORSHIP, PROBATE COURTS AND PROCEDURE

  • ACQUISITION, OWNERSHIP AND TRANSFER OF REAL PROPERTY

  • STATE AND MUNICIPAL TAXATION

  • GROUP INSURANCE FOR NH GOVERNMENT EMPLOYEES

  • STATE FAMILY LEAVE BENEFITS

  • EMERGENCY AND NON-EMERGENCY MEDICAL CARE

  • HOSPITAL VISITATION AND NOTIFICATION

  • AUTHORITY TO ACT IN MATTERS AFFECTING FAMILY MEMBERS

  • MARITAL RIGHTS IN COURT PROCEEDINGS

Couples should consider entering into a prenuptial agreement before joining in a civil union to clarify what they consider to be the length of their relationship, the ways they wish their property to be divided (if their wishes vary from usual dissolution laws), and other matters of particular concern to them
