Representing More Than One Party

REPRESENTING SELLER IN TRANSACTIONS CLOSED BY TITLE COMPANY
In some cases, where representation of Buyer, Seller and Lender is all being handled by a Title Company, the Seller may wish independent counsel. Sometimes things go wrong and assistance is required in negotiating terms, or in enforcing the terms of an agreement. The Seller may simply desire independent counsel and advice during the process. In those circumstances, we would arrange with the Title Company or Brokers to provide us with advance review copies of all documents the Client might be asked to sign, and consult with the Client confidentially. Representation at the Closing may also be provided.
REPRESENTING THE BUYER IN A TRANSACTION BEING CLOSED BY A TITLE COMPANY
Where a Title Company is handling the entire transaction for Buyer, Seller and Lender, the Buyer may want independent counsel to review materials such as the Title Insurance Commitment and Settlement Statement. Under these circumstances, we would obtain in advance copies of all Closing Documents, and make confidential recommendations to the Client.
REPRESENTING BUYER AND LENDER
On occasion, a Buyer is asked to select the closing company, or the attorney is asked by the Mortgage Company to select a Title Company or to handle the Loan Closing. Where we have consent from both Buyer and Lender, we can represent both the Buyer and the Lender. In this situation, we would provide the same services indicated above plus whatever additional requirements may be specified by the lender.
